These Terms contain a binding arbitration agreement and class-action waiver for U.S. users (see §18). If you do not agree, do not use Wrinkles.

1) What these Terms cover

These Terms of Use (“Terms”) govern your access to and use of Wrinkles—our mobile apps, websites, APIs, emails, and services (collectively, the “Service”). Our Privacy Policy explains how we collect, use, and share information; it’s incorporated into these Terms.

By creating an account, downloading, or using the Service, you agree to these Terms and the Privacy Policy.

2) Eligibility & accounts

• You must be 13+ (or the minimum age of digital consent where you live) to use the Service. If you are under the age of majority, a parent/guardian must review these Terms and consent.

• Keep your login secure and accurate. You are responsible for activity on your account.

• We may offer “Sign in with Apple/Google,” passkeys, or magic links. Authentication ≠ consent to receive marketing—see Privacy Policy for consent choices.

3) Location & safety

Wrinkles uses device location to trigger place-based stories and features.

• Do not use the Service while driving or where attention is required.

• Location and maps are not guaranteed accurate; do not rely on the Service for navigation or safety-critical decisions.

• Some features (e.g., descendant unlocks) require being within a small geofence and may not function if you disable location.

4) Our content & your license

Unless indicated otherwise, the Service and all content we provide—stories, audio, video, text, maps, data, UI, and brand assets (“Wrinkles Content”)—are owned by Explore or our licensors and are protected by IP laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use Wrinkles Content via the Service for personal, non-commercial use. We may change or remove Wrinkles Content at any time.

You may not copy, scrape, archive, sell, sublicense, or create derivative works from Wrinkles Content except as permitted by law or with our written permission.

5) Your content & license to us

You may submit or create content (“User Content”), including comments, “wrinkles,” photos, profiles, and generational posts.

• Ownership. You retain your rights to User Content.

• License. You grant Explore a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt (for formatting/transcoding), publish, perform, display, and distribute your User Content in connection with operating, improving, and promoting the Service.

• Promises. You represent you have the rights to post your User Content; it does not infringe others’ rights, violate law, or contain personal data of others without consent.

• Moderation. We may remove or restrict User Content we reasonably believe violates law or these Terms.

6) Community guidelines (summary)

Be respectful. No illegal content, harassment, hate, doxxing, sexual exploitation, or glorification of violence. Don’t impersonate others, spam, or attempt to manipulate the Service. Respect property and local rules; do not trespass. Report issues via [support@wrinkles.io].

7) Generational posts (descendant unlocks)

Wrinkles allows a poster to mark a place-bound post as “Generational” and attach a policy (ancestor/poster, lineage limit, and a geofence).

• Poster access. Poster (and any designated custodians) may view anywhere (subject to time gates).

• Descendant unlock. Descendants may unlock only on arrival within the geofence and if the policy is satisfied.

• Family links. Family relationships are self-declared and may require mutual confirmation or proofs. We use such information only to evaluate policy eligibility; we don’t display full family trees.

• No guarantees. We may remove content or features; availability is not guaranteed.

• Consent. Do not upload sensitive content or others’ personal data without permission.

8) Recommendations & AI features

Wrinkles may generate AI-assisted recommendations or answers (e.g., places to visit/eat, context Q&A). These outputs are informational only and may be incomplete or inaccurate. Always verify with official sources. You are responsible for your decisions.

9) Subscriptions & in-app purchases

9.1 Where you buy. You may purchase subscriptions or other paid features (a) through the Apple App Store or Google Play (in-app purchase), or (b) if we offer it, directly on our website (card/Stripe). Your store provider’s terms govern store-billed purchases (including billing, renewals, cancellations, and refunds). Web-billed purchases are governed by this Section 9.

9.2 Auto-renewal. Subscriptions auto-renew for the same term (e.g., monthly or annual) and your account will be charged unless you cancel at least 24 hours before the current period ends. You can manage or cancel any time:

9.3 Free trials. If we offer a trial, we’ll tell you the length and price afterward. When the trial ends, your subscription converts to a paid plan and auto-renews unless you cancel before the end of the trial. Where a store requires it, any unused portion of a trial may be forfeited when you start a paid plan.

9.4 Prices & taxes. We may change prices prospectively; if we do, we’ll give you notice (store or in-app/email). If you keep using the Service after the change takes effect, you accept the new price; otherwise cancel before renewal. Prices may include or exclude taxes depending on your region; the store or our payment processor will calculate and collect VAT/GST/sales tax where applicable.

9.5 Refunds.

App Store / Google Play: Refunds are handled by the store, not Explore. Please submit your request through the store’s refund process.
Web-billed: We generally do not provide refunds for partial months/years or unused services, except where required by law (see EU/UK Addendum). You can cancel any time; your access continues until the end of the paid period.

9.6 Upgrades/downgrades. If we offer plan changes, we’ll tell you when the change takes effect (immediately or next period) and how any proration works.

9.7 Promo codes & limited-time offers. Any special pricing applies only for the stated term and will renew at the then-current rate unless cancelled.

10) Advertising & sponsored “Moments”

We may display sponsored content (e.g., a short message after a story) with pacing/frequency caps. Sponsored content will be labeled. Advertisers are responsible for their claims; interactions with third parties are at your discretion and risk.

11) Third-party links & services

The Service may link to third-party sites or enable partner interactions (e.g., bookings). We don’t control those sites and aren’t responsible for their content, policies, or practices.

12) Intellectual property claims & DMCA

We respect IP rights. If you believe content infringes your copyright, send a notice to our DMCA Agent:

Your notice must include the elements required by 17 U.S.C. §512(c)(3). We may remove material and terminate repeat infringers where appropriate.

13) Prohibited uses

You agree not to:

• Reverse engineer, decompile, or scrape the Service or Circumvent technical protections;

• Access, search, or download the Service using bots or automated methods except with our written permission;

• Upload malware or attempt to gain unauthorized access;

• Collect or harvest users’ data without consent;

• Use the Service for unlawful purposes.

14) Privacy

See our Privacy Policy at [wrinkles.io/privacy]. It explains what we collect (e.g., location, device, usage), why we collect it, and your choices.

15) Changes to the Service

We may add, change, or remove features, content, or functionality at any time, with or without notice. We are not liable for changes or discontinuations.

16) Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPLORE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

17) Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXPLORE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

18) Dispute resolution; arbitration; class-action waiver (U.S.)

Please read—affects your rights. You and Explore agree to resolve disputes only by binding arbitration on an individual basis, except you may assert claims in small-claims court. Class actions are waived.

• Rules & forum. Arbitration will be administered by the AAA under the Consumer Arbitration Rules by a single arbitrator in [County, State], or by video/telephone at your election.

• Governing law. These Terms are governed by the laws of [Delaware or California], and the Federal Arbitration Act governs arbitration.

• Opt-out. You may opt out of arbitration by emailing legal@wrinkles.io within 30 days after you first accept these Terms; include your full name, account email, and a statement that you opt out of arbitration.

• Injunctive relief. Either party may seek injunctions in court for IP misuse or unauthorized access.

If arbitration is found unenforceable, disputes will be litigated exclusively in the state or federal courts located in [County, State], and you consent to jurisdiction there.

19) Indemnification

You will indemnify and hold harmless Explore and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or law.

20) Termination

You may stop using the Service at any time. We may suspend or terminate your access if we believe you violated these Terms or law, or for operational/security reasons. Upon termination, licenses granted to you end; provisions that by nature should survive (e.g., IP, disclaimers, liability limits, arbitration) survive termination.

21) Changes to these Terms

We may update these Terms. We will post the updated Terms with an effective date and, if changes are material, provide notice (e.g., in-app, email). Continued use after the effective date constitutes acceptance.

22) International use

We make no representations that the Service is appropriate or available in all jurisdictions. You are responsible for compliance with local laws. If you are in the EU/UK or regions with specific consumer rights, some terms may not apply; see local notices in the Privacy Policy.

23) Export & sanctions

You may not use the Service if you are subject to U.S. government sanctions or in a country embargoed by the U.S. You agree to comply with U.S. export laws.

24) Miscellaneous

These Terms (plus the Privacy Policy) are the entire agreement between you and Explore regarding the Service. If any provision is unenforceable, the remainder remains in effect. No waiver is a continuing waiver. You may not assign these Terms without our consent; we may assign them. Headings are for convenience only.

25) EU/UK Consumer Addendum

This Addendum applies only to users who reside in the EEA/UK and use Wrinkles as consumers (not for business).

A) Cooling-off / right of withdrawal (14 days).

If you purchase a subscription on our website (not via Apple/Google), you have a legal right to withdraw within 14 days from the contract date unless you asked us to start the digital service immediately (e.g., instant access) and acknowledged you’d lose the withdrawal right once performance began. If you do not request immediate performance and withdraw within 14 days, we will refund amounts you paid for that subscription. Store-billed purchases (Apple/Google): App Store and Google Play manage billing and may also handle cooling-off rights and any refunds; please use the store’s tools.

B) Digital content remedies.

If the Wrinkles digital service fails to conform to contract, you may be entitled to repair, replacement, price reduction, or refund under your local law (e.g., EU Digital Content Directive; UK Consumer Rights Act 2015). Contact support@wrinkles.io and we will work with you (or the store, if applicable) to resolve.

C) ODR/ADR information.

If you live in the EU, you may access the European Commission Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Explore does not agree in advance to use any specific ADR body, but we will consider ADR in good faith where required by law. For UK consumers, you may seek advice from Citizens Advice (https://www.citizensadvice.org.uk/). Nothing in these Terms prevents you from bringing a claim in the courts of your country of residence where mandatory law gives you that right.

D) VAT & pricing.

Where required, prices shown to EEA/UK consumers will be VAT-inclusive and VAT will be collected and remitted by the store or our payment processor.

E) Governing law and forum for EU/UK consumers.

Any choice of law or forum in these Terms does not deprive you of the protection of mandatory consumer law in your country of residence. You may bring claims in the courts of your country of residence where such rights apply.
